Description: Constitutional basis in Article I, Section 8.“Congress shall have the power to promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries.” First patent law was enacted in 1790. The present law is codified in Title 35 of the United States Code. What is a U.S. Patent?:- A form of personal property granted by the U.S. government giving the owner the right to exclude others from making, using, selling, offering for sale or importing the claimed invention for a period of 20 years from the application filing date.
